Welcome to HookYourKeys! The terms “we”, “us” and “our” refer to HookYourKeys. HookYourKeys operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the “Services”). HookYourKeys is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referred to in them (these “Terms of Service”), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

Nothing in these Terms of Service excludes, restricts or modifies any rights or remedies you have under the Australian Consumer Law or any other consumer protection law that cannot be excluded by contract.

1. Access and account

By agreeing to these Terms of Service, you confirm that you are at least the age of majority in your state, territory or province of residence, and that you have given consent for any of your minor dependants to use the Services on devices you own, purchase or manage.

To use the Services, including browsing our store or buying our products, you may be asked to provide certain information, such as your email address and your billing, payment and shipping details. You confirm that all information you provide is correct, current and complete, and that you have the right to provide it. You are responsible for keeping your account login details secure and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.

2. Our products

We make every effort to describe and display our products accurately. However, colours and product appearance may look different depending on your device, screen and settings. Product descriptions may change from time to time. We may discontinue any product at any time and may limit the quantities of any product we offer to any person, region or jurisdiction.

Our products come with guarantees under the Australian Consumer Law, including that they will be of acceptable quality and match their description. Nothing in this section limits those guarantees.

3. Orders

When you place an order, you are making an offer to purchase and you authorise us and our payment processors to charge your selected payment method for the total amount of your order. We may accept or decline your order for any reason, subject to applicable law. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before your order is accepted.

Please review your order carefully before submitting it, as we may not be able to cancel an order once it has been accepted and sent to our supplier. If we do not accept, change or cancel your order, we will try to notify you using the email address, billing address and/or phone number you provided, and we will refund any amount you have paid for the affected items.

Returns and refunds are handled in accordance with our Refund Policy, which does not limit your rights under the Australian Consumer Law.

You confirm that your purchases are for your own personal or household use and not for commercial resale or export.

4. Prices and billing

Prices are shown in Australian dollars (AUD) or in your local currency where available, as displayed at checkout. For orders delivered within Australia, prices include GST. For orders delivered outside Australia, GST does not apply, but your order may be subject to import duties, taxes or customs fees charged by your country. Unless we state at checkout that these are included, you are responsible for paying them, and we are not responsible for delays caused by customs. The price charged will be the price in effect when you place your order, as set out in your order confirmation email.

Prices, discounts and promotions may change without notice, but changes will not affect orders you have already placed. From time to time we may offer promotions with their own terms and conditions. If those terms conflict with these Terms of Service, the promotion terms will apply.

You agree to provide current, complete and accurate purchase, payment and account information, and to update it promptly when it changes so that we can complete your transactions and contact you as needed. You confirm that: (1) you are authorised to use the payment method you provide; (2) the payment information you provide is true, correct and complete; (3) charges you incur will be honoured by your payment provider; and (4) you will pay the charges you incur at the posted prices, including shipping and any applicable taxes.

5. Shipping and delivery

Our products are shipped directly from our suppliers, some of whom are located overseas. All delivery times shown are estimates only. Delays can sometimes occur because of shipping carriers, customs processing, or events outside our reasonable control, such as natural disasters, severe weather, industrial action, supply shortages, utility or telecommunications outages, cyber incidents or government actions.

Responsibility for your order passes to you once it has been delivered to the shipping address you provided. If your order does not arrive within a reasonable time, please contact us and we will work with you to arrange a replacement or refund. See our Shipping Policy for more details.

6. Intellectual property

Our Services, including all trademarks, brands, text, images, graphics, product reviews, video and audio, are owned by HookYourKeys or its licensors and are protected by Australian and international trade mark, copyright and other intellectual property laws. Our product listings are managed and owned by HookYourKeys.

Buying or receiving a product does not give you any intellectual property rights, including any patent, copyright, trade mark or other proprietary right, in the product, its design, software or underlying technology. All such rights remain with HookYourKeys or the original rights holder.

You may use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display or perform, republish, download, store or transmit any material on the Services without our prior written consent. Except as expressly stated in these Terms of Service, nothing in them grants you a licence or other rights under any intellectual property of HookYourKeys, Shopify or any third party. All rights not expressly granted are reserved by HookYourKeys.

HookYourKeys’s name, logos, product and service names, designs and slogans are trade marks of HookYourKeys or its licensors, and you must not use them without our prior written permission. Shopify’s name, logo, product and service names, designs and slogans are trade marks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are the trade marks of their respective owners.

7. Optional tools

We may give you access to customer tools offered by third parties as part of the Services. We do not monitor or control these tools. They are provided “as is” and “as available”, without any endorsement from us, and to the extent permitted by law, we are not liable for your use of them. Any use of optional tools is at your own risk, and you should make sure you are familiar with and agree to the terms on which they are provided by the relevant third-party provider.

We may also offer new features through the Services in the future, including new tools and resources. These will also form part of the Services and are subject to these Terms of Service.

8. Third-party links

The Services may contain materials and links to websites operated by third parties, including embedded third-party functionality. We are not responsible for reviewing or evaluating the content or accuracy of any third-party materials or websites. If you choose to access them, you do so at your own risk. To the extent permitted by law, we are not liable for any harm or damage related to your use of third-party websites or your purchase or use of any products, services or content on them. Please review the third party’s policies and practices carefully before entering into any transaction. Complaints, claims, concerns or questions about third-party products and services should be directed to the third party.

9. Relationship with Shopify

HookYourKeys is powered by Shopify, which enables us to provide the Services to you. When you use the Services, your device communicates with Shopify’s systems to deliver them. Section 10 explains how Shopify uses and processes information from these interactions. However, any purchases you make in our store are made directly with HookYourKeys. Shopify is not responsible for any aspect of sales between you and HookYourKeys, including any injury, damage or loss resulting from purchased products, and you release Shopify and its affiliates from all claims, damages and liabilities arising from your purchases and transactions with HookYourKeys.

10. Privacy Policy

Our Privacy Policy explains how we collect, use and disclose personal information from your use of the Services. Because the Services are hosted by Shopify, Shopify collects, uses, processes and stores personal information about your access to and use of the Services, including information about your transactions. Shopify may use this information to provide, secure and improve the Services, process transactions, and help prevent fraud on this website and other websites powered by Shopify. Information collected when you use the Services, including information collected automatically about your browsing activity, will be shared with Shopify and with third parties that may be located in countries other than where you live, in order to provide services to you. 11. Feedback

If you submit, upload, post, email or otherwise send us any ideas, suggestions, feedback, reviews, proposals, plans or other content (together, “Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium and for any purpose, including commercial use. For example, we may use it to operate, evaluate, improve and promote the Services.

You confirm that: (1) you own or have all necessary rights to your Feedback; (2) you have disclosed any payment or incentive you received in connection with your Feedback; and (3) your Feedback complies with these Terms of Service. We are not obliged to keep your Feedback confidential, pay you for it or respond to it.

We may, but are not obliged to, monitor, edit or remove Feedback that we reasonably consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes anyone’s intellectual property or these Terms of Service. Your Feedback must not infringe any third party’s rights, including copyright, trade mark, privacy or personality rights, and must not contain defamatory, unlawful, abusive or obscene material, or any virus or malware. You must not use a false email address, pretend to be someone else, or otherwise mislead us or others about the origin of any Feedback. You are responsible for any Feedback you submit and its accuracy.

12. Errors, inaccuracies and omissions

Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We may correct any errors, inaccuracies or omissions, update information, or cancel orders if information is inaccurate, including after an order has been submitted. If we cancel an order after payment has been collected, we will refund you in full.

13. Prohibited uses

13.1 You may use the Services for lawful purposes only. You must not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to breach any international, federal, state, territory or local law or regulation; (c) to infringe our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, intimidate or disparage any of our staff or any other person; (e) to send false or misleading information; (f) to send, knowingly receive, upload, download, use or re-use any material that does not comply with these Terms of Service; (g) to send, or arrange the sending of, any advertising or promotional material, including junk mail, chain letters, spam or similar solicitations; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or that we reasonably believe may harm HookYourKeys, Shopify or users of the Services, or expose them to liability.

13.2 You also agree not to: (a) upload or transmit viruses or any other malicious code that will or may affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any part of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm or pretext the Services; (e) use any robot, spider, scraper, data gathering or extraction tool, automated device or process, or AI tool (such as agentic AI) to access the Services, except as permitted under Section 14; or (f) interfere with, bypass or circumvent the security or authorisation features, robot exclusion headers or other measures we use to restrict access to the Services.

We may suspend, disable or terminate your account at any time, without notice, if we reasonably determine that you have breached these Terms of Service.

14. Agents

14.1 This section (“Agent Terms”) applies if you use, allow, enable or cause an Agent to access, use or interact with the Services. “Agent” means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, and that can operate on behalf of, or using, a person’s device without direct supervision.

14.2 No Agent may access, use or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with Section 14.4. No Agent may access, use or interact with the Services if we have asked it not to.

14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses and interacts with the Services.

14.4 Agents must: (a) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the Agent’s name by including “Agent/[agent name]” in the request’s user agent string; (b) not conceal or obscure that any access, use or interaction is from an Agent, such as by (i) mimicking human behaviour and interaction patterns, or (ii) completing or circumventing CAPTCHAs or other measures intended to distinguish computers from humans; (c) respond truthfully to any question or prompt seeking to determine whether interactions are coming from a human or a computer; and (d) not circumvent or otherwise avoid any measure intended to block, limit, modify or control whether and how Agents access, use or interact with the Services.

15. Termination

We may terminate this agreement or your access to the Services (or any part of them) at any time without notice. You will remain liable for all amounts due up to and including the date of termination. Termination does not affect any order we have already accepted, or your rights under the Australian Consumer Law. The following sections continue to apply after termination: Intellectual property, Feedback, Termination, Disclaimer of warranties, Limitation of liability, Indemnification, Severability, Waiver and entire agreement, Assignment, Governing law, Privacy Policy, and any other provisions that by their nature should survive termination.

16. Disclaimer of warranties

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Subject to those guarantees and any other rights that cannot be excluded by law, information on the Services is provided for general information purposes only, and we do not warrant that it is accurate, complete or useful. To the extent permitted by law, the Services are provided “as is” and “as available”, and we do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.

17. Limitation of liability

Nothing in these Terms of Service excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded or limited.

Subject to that, and to the fullest extent permitted by law, HookYourKeys, its contractors, service providers and licensors, and Shopify and its affiliates, are not liable for any indirect, incidental, special, punitive or consequential loss or damage, including lost profits, lost revenue, lost savings or loss of data, arising from your use of the Services or any content made available through them, even if advised of the possibility of such loss.

18. Indemnification

You agree to indemnify HookYourKeys and Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers, against any losses, damages, liabilities or claims, including reasonable legal costs, payable to a third party to the extent they arise from: (1) your breach of these Terms of Service or the documents they incorporate by reference; or (2) your breach of any law or the rights of a third party.

We will notify you of any claim covered by this section. A failure to notify you promptly will not relieve you of your obligations unless you are materially prejudiced by it. We may control the defence and settlement of the claim at your expense, including choice of lawyers, but we will not settle any claim that requires non-monetary obligations from you without your consent, which you must not unreasonably withhold. You will cooperate in the defence of the claim, including by providing relevant documents.

19. Severability

If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision will still be enforced to the fullest extent permitted by law, and the unenforceable part will be treated as removed from these Terms of Service. This will not affect the validity and enforceability of the remaining provisions. Nothing in these Terms of Service limits any rights you have under consumer protection laws or other laws that cannot be excluded by contract. If any part of these Terms of Service conflicts with those rights, those rights will apply.

20. Waiver and entire agreement

If we do not exercise or enforce any right or provision of these Terms of Service, that does not waive that right or provision. These Terms of Service, together with any policies or operating rules we post on this site or in relation to the Services, are the entire agreement between you and us and govern your use of the Services. They replace any previous agreements, communications and proposals between you and us, whether oral or written, including any earlier versions of these Terms of Service. Any ambiguity in the interpretation of these Terms of Service will not be construed against the drafting party.

21. Assignment

You may not transfer or assign this agreement or any of your rights or obligations under it without our prior written consent, and any attempt to do so will be void. We may transfer or assign these Terms of Service and our rights and obligations under them, provided this does not reduce your rights under the Australian Consumer Law.

22. Governing law

These Terms of Service are governed by the laws of New South Wales, Australia. You and HookYourKeys submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that may hear appeals from them. Nothing in this section limits any rights you have to bring claims in your local courts or to rely on mandatory laws that apply where you live.

23. Translations

These Terms of Service may be available in languages other than English. If there is any inconsistency between the English version and a version in another language, the most current English version will apply. Any disputes arising from these Terms of Service will be resolved in English unless we decide otherwise or the law requires it.

24. Headings

Headings are included for convenience only and do not limit or affect these Terms of Service.

25. Electronic communications

By using the Services or placing an order, you agree that we may send you transactional and service-related communications electronically, including by email, in-account notice or posting on the Services. These may relate to your orders, account, purchases, returns, these Terms of Service or other matters related to the Services. You are responsible for keeping your contact information up to date.

26. Changes to these Terms of Service

You can review the most current version of these Terms of Service at any time on this page. We may update, change or replace any part of these Terms of Service by posting the changes on our website, so please check this page from time to time. We will notify you of any material changes as required by law, and those changes will take effect on the date stated in the notice. Your continued use of the Services after changes are posted means you accept those changes. Changes will not affect orders you placed before the changes took effect.
